Terms and Conditions: Chirnside Holiday Cottages

1. The Agreement

The contract of hire is between the Hirer and the property owner (Chirnside Holiday Cottages). The contract is deemed to have been made once the Hirer has confirmed the booking via the online booking mechanism or via a printed booking form. Bookings cannot be accepted without a valid credit/debit card to guarantee the reservation. Upon receipt of a booking, Chirnside Holiday Cottages will dispatch a confirmation email or letter. The Hirer must be at least 18 years of age at the time of booking.

2. Booking and Payment

The Hirer is responsible for all persons included in the booking and must ensure they are aware of these conditions. Chirnside Holiday Cottages reserves the right to decline any booking or refuse to hand over keys to any person who has not complied with these conditions.

  • Standard Bookings: The full booking balance must be paid at the time of booking.

  • Late Bookings: For reservations made less than 28 days before arrival, the total amount is payable immediately.

3. Number of People Using the Accommodation

The property is let for holiday purposes only. Only the Hirer and their named party may occupy the lodge. The number of guests must not exceed the maximum capacity stated on the booking form unless prior written agreement is obtained from Chirnside Holiday Cottages (additional charges may apply). The owner reserves the right to refuse admittance or revoke a booking if this condition is breached or if the party is considered unsuitable for the property.

4. Arrival and Departure

Unless otherwise agreed in writing, the lodge will be available for check in between 3:00 pm - 9:00 pm on the day of arrival and must be vacated by 10:00 am on the day of departure.

5. Cancellations or Changes by You

A booking is a legally binding contract. Cancellations must be notified in writing as soon as possible.

  • More than 28 days’ notice: A full refund will be issued for a single lodge booking.

  • Less than 28 days’ notice: The Hirer remains liable for the full hire amount.

  • Changes: We may be able to change your dates subject to availability and agreement. A re-booking fee may apply.

6. Festive Dates (Christmas and New Year)

Bookings for festive periods are subject to specific terms:

  • A non-refundable 20% deposit is required.

  • Cancellation more than 60 days before arrival: Refund issued minus the non-refundable deposit.

  • Cancellation between 60 and 28 days before arrival: The Hirer is liable for 50% of the hire amount.

  • Cancellation less than 28 days before arrival: The Hirer is liable for the full hire amount.

7. Your Responsibilities

The Hirer agrees:

  • To supervise children, babies, dogs, and vulnerable adults at all times.

  • Dogs: Well-behaved dogs are welcome subject to a supplement. They must be kept under control, never left alone in the lodges, and kept off beds and furniture.

  • To leave the accommodation in good order and a clean condition. A cleaning charge will be levied if the lodge is left in an unsatisfactory state.

  • To report any breakages or damage and pay for repair or replacement (excluding reasonable wear and tear).

  • To respect neighbors by avoiding nuisance or annoyance. We request that arrivals and departures occur outside the hours of 11:00 pm – 7:00 am where possible.

  • To allow Chirnside Holiday Cottages reasonable access to the property if deemed necessary.

  • Security Deposit: A refundable security deposit of £100 is required for each stay and is provided by payment-card pre-authorisation before arrival. This is a temporary hold and is not normally charged. We may charge all or part of the authorised amount where reasonably necessary to cover damage, missing items, exceptional cleaning or other costs resulting from a breach of the booking conditions. Any amount charged will be limited to the reasonable cost incurred, up to £100. Where no charge is required, the authorisation will be released following departure. The time taken for the funds to become available again is determined by your card issuer.

8. Termination of Stay

If, in our opinion, any guest is unsuitable to continue their stay due to unreasonable behavior, damage, or nuisance, the contract may be discharged immediately. Craigmyle Estates Ltd may repossess the property, and the Hirer will remain liable for the full cost of hire with no refund due.

9. Complaints

We want you to have an enjoyable stay at Chirnside Holiday Cottages. In the unlikely event of a complaint, please contact us (or our agent) immediately as per the details in your Welcome Pack. No complaints can be considered after you have departed the property.

10. Liability

Chirnside Holiday Cottages cannot accept responsibility for material loss, damage, or inconvenience caused by the property’s services (plumbing/electrical) or exceptional weather. No responsibility is accepted for loss or damage to guests’ property, vehicles, or pets during their stay.

11. Cancellation by Us

If the property becomes unavailable (e.g., due to fire or flood), we reserve the right to cancel the booking and provide a full refund. Our liability is limited to the return of monies paid.

12. Short-Term Letting Licence & Force Majeure

  • Licensing: If Local Council regulations result in the suspension of operations or inability to fulfill the agreement, a full refund will be provided.

  • Force Majeure: We cannot accept liability for cancellations or delays caused by events outside our control (e.g., war, civil strife, industrial disputes, epidemics, or extreme weather). We strongly recommend guests hold valid Travel Insurance.

13. Waiver

Failure by Chirnside Holiday Cottages to enforce any term of this agreement at any time does not constitute a waiver of that right.
